NRI Surrogacy Documentation

Surrogacy is not a codified legislation in India. It is estimated that 15% of the couples in the world are infertile. That is a huge number. Surrogacy is a way in which a substitute is appointed in place of the mother to give birth to a child. The New Encyclopedia Britannica defines ‘surrogate motherhood’ as the practice in which a woman bears a child for a couple unable to produce children in the usual way. India has become a surrogacy destination as the surrogacy in developed countries comes at a very heavy price and India can provide surrogate mothers at a lesser expense and complications. Thus, a lot of foreign nationals come to India regards the same.

In India, the surrogate mother relinquishes all rights to the babies and the birth certificate is made in the name of the genetic mother and father. The law does not recognize the surrogate mother as having legitimate rights to the baby.
